Terms of Service

These Terms govern your use of Care Command Center (the “Service”). By using the Service, you agree to them. If you do not agree, do not use the Service.

1. Organizational tool only

The Service helps users organize caregiver information. It is not a medical provider, pharmacy, insurer, lawyer, financial adviser, emergency service, or substitute for professional judgment. It does not diagnose, treat, monitor, verify, or guarantee the accuracy of care information.

2. Emergencies and medical decisions

Do not use the Service for emergency communication or time-critical monitoring. Call 911 or your local emergency service for an emergency. Always confirm medications, doses, allergies, appointments, and instructions with qualified professionals and original records before acting.

3. Eligibility and authority

You must be at least 18 and legally able to agree to these Terms. You represent that you have permission or lawful authority to enter, manage, and share information about each person in your workspace. You are responsible for obtaining any consent required from the person receiving care or their authorized representative.

4. Account security

Access uses Google authentication through our authentication provider. You are responsible for protecting your Google account, using a long and unique password, enabling 2-Step Verification when available, keeping devices locked, signing out of shared devices, and promptly addressing suspected unauthorized access. We do not receive or store your Google password.

5. Prohibited information

Do not enter Social Security numbers, full bank-account or payment-card numbers, CVVs, PINs, passwords, security answers, tax identifiers, portal credentials, authentication codes, private cryptographic keys, or other information not reasonably necessary for caregiver organization. Do not upload illegal content, malware, or information you lack authority to possess or share.

6. User responsibility

You are responsible for your entries, decisions, invitations, sharing settings, device security, exports, and printed summaries. Review access regularly and remove people who no longer need it. Printed or downloaded information is outside the Service’s access controls.

7. Privacy and health information

Our Privacy Notice explains how information is handled. The Service is offered directly to consumers and is not represented as a HIPAA-compliant service or as a business associate of a health care provider. Do not use it on behalf of a HIPAA-covered entity unless a separate written agreement expressly permits that use.

8. Availability and changes

The Service may change, be interrupted, or be discontinued. We may limit or suspend access to protect users, comply with law, address misuse, or maintain the Service. We may update these Terms prospectively by posting revised terms and an effective date.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST DATA, LOST PROFITS, PERSONAL INJURY, CARE DECISIONS, OR UNAUTHORIZED ACCESS ARISING FROM USE OF OR INABILITY TO USE THE SERVICE. TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE DURING THE SIX MONTHS BEFORE THE CLAIM OR $100. THIS LIMIT DOES NOT APPLY WHERE PROHIBITED BY LAW.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Service and its operator from third-party claims arising from your unlawful content, violation of these Terms, lack of authority to manage another person’s information, or misuse of sharing features.

12. Governing law and disputes

Ohio law governs these Terms, without regard to conflict-of-law rules. Courts located in Summit County, Ohio will have exclusive jurisdiction, except where consumer law requires otherwise. Before filing a claim, each party agrees to provide written notice and attempt informal resolution for 30 days.

13. General

If one provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not transfer your rights without consent. These Terms and the Privacy Notice are the entire agreement concerning the Service.

14. Contact

Authenticated users may submit legal, privacy, correction, or deletion requests through Account & Security in the Service.
